As far as it affects the legal industry that I work within, we are more likely to see regulation that affects how lawyers use AI than sweeping changes targeting its use altogether.

In the last several years, AI has been more of a problem than a solution in the legal field. As AI progresses, so does its use. Attorneys are using AI to perform legal research and even draft motions and pleadings. However, many attorneys are not vetting the information obtained through AI research and, consequently, filing documents that misstate the law.

I believe this will continue to be a problem for years to come because there will always be attorneys that will look for the easy shortcut, which makes finding an experience and high-quality attorney even more important. It has become so problematic that the Florida Bar, along with other states, has formed panels or committees to investigate and potentially create rules of ethical conduct that govern an attorney's use of AI programs. Additionally, several state and federal courts are looking to create or amend rules of both criminal and civil procedure to govern the use of AI research and auto generated motions and pleadings. Currently, AI is not at the point where it is a reliable enough to substitute for the legal mind of an attorney or the legal analysis an experienced attorney offers to their clients.

The majority of AI programs access the internet in its entirety, which includes vast amounts of incorrect information. I have used AI programs to perform legal research, but more often than not its analysis of a case or statute is not correct. It is helpful in finding a case that I might not have found on my own, but it has not progressed past that. Though, I do believe in the next 5 years it will be more robust and its allowed use more defined by the courts and governing state and federal bars.

As a criminal defense lawyer, I foresee AI having an impact on my field. As each day passes, and AI is installed in our cars, our mobile devices, and used in surveillance systems, more and more of our lives are recorded, documented, and analyzed. In 5-10 years, I think very little aspects of our lives will be private. Consequently, it will be harder for the State to prosecute an innocent person if the alleged facts are recorded as well as it will be harder to defend a guilty client. This makes using the services of a high quality and experienced criminal defense attorney, like myself, even more important in the future.

Over the next five years, AI regulation will get simpler in principle, but stricter in practice: less debate about "what AI is," more focus on who is accountable and how the system is controlled.

For low-risk use cases (drafting, assistants, suggestions), the expectations will stay basic: don't mislead users, handle data carefully, and be able to switch features off fast when something goes wrong. For areas where AI affects people and money (finance, hiring, healthcare, education), we'll see a standard checklist become normal: pre-launch checks, ongoing monitoring, clear limits, logging, and an incident plan.

Last month a user asked me if our AI is "actually psychic." That one question captures the whole regulatory gap right now. There's zero framework for AI in wellness or spiritual guidance. None. And yet people are making real emotional decisions based on what AI tells them.

This is extremely hard to predict. The tremendously accelerated pace in which AI is moving makes it even hard to predict a year from today. AI tools and capabilities are constantly changing, opening new horizons and infiltrating new sectors every day. It's a race, and leading countries in this race (for example China and the US) will not enforce regulations that may limit and slow down progress. I can't foresee how these guardrails will progressively come to existence. Surely we will still have high level principles, but also industry specific regulations that are (hopefully) human centered. Liability is a big concern, so is AI bias. If an AI model trained on diagnosing diseases, misdiagnoses a patient, who's liable? Is it the Dr. the team that trained the model, the vendor that's selling it? Is the data trained on representing everyone (age, sex, race)? Unfortunately it is a system susceptible to errors (sometimes fatal errors) before correcting we're able to identify appropriate regulations and correct the path. Liability and the erosion of public trust are the two main forces that will ultimately make regulations unavoidable.
